1.1 These Terms and Conditions apply to all offers, agreements and deliveries of Rexar, established in Hazerswoude Rijndijk, the Netherlands, hereinafter referred to as “Rexar”.
1.2 By placing an order, the customer confirms having read, understood and accepted these Terms and Conditions.
1.3 Deviations from these Terms and Conditions are only valid if confirmed in writing by Rexar.
1.4 The products supplied by Rexar are intended for professional, analytical, technical and laboratory-related applications.
2.1 The products offered by Rexar are supplied as Chemical Reference Materials, Analytical & Laboratory Chemicals or Technical Compounds, depending on the relevant product category.
2.2 The products are not intended for human or animal consumption, nor for medical, therapeutic or diagnostic use.
2.3 By placing an order, the customer declares:
to possess sufficient knowledge and expertise in handling chemical substances;
to have appropriate facilities for storage, handling and use;
to use the products solely in compliance with applicable laws and regulations.
2.4 Rexar does not provide advice regarding applications outside analytical, technical or laboratory-related activities.
3.1 All offers on the website are non-binding and may be modified or withdrawn at any time.
3.2 All prices are stated inclusive of VAT unless explicitly stated otherwise, and exclusive of shipping or administrative costs.
3.3 Obvious errors or inaccuracies in pricing or product information do not bind Rexar.
4.1 Rexar reserves the right to refuse or cancel orders in whole or in part if there is reasonable doubt regarding:
the legality of the order;
the intended use of the products;
compliance with these Terms and Conditions.
4.2 Orders are processed only after full payment has been received.
5.1 Stated delivery times are indicative and do not constitute binding deadlines.
5.2 The risk of loss or damage passes to the customer upon transfer of the goods to the carrier.
5.3 The delivered products remain the property of Rexar until full payment has been received.
6.1 Rexar shall not be liable for any damage resulting from improper, incorrect or non-compliant use of the supplied products.
6.2 The customer bears full responsibility for compliance with all applicable laws and regulations relating to the storage, use, transport and disposal of chemical substances.
6.3 Rexar’s liability is in all cases limited to the invoice amount of the relevant delivery, unless caused by intent or gross negligence.
7.1 Due to the nature of the products (chemical substances), the right of withdrawal is excluded.
7.2 Returns are accepted only with prior written approval from Rexar.
7.3 Returned products must be unopened, unused and in their original sealed packaging.
8.1 In the event of force majeure, Rexar shall be entitled to suspend performance of the agreement or to terminate it in whole or in part.
8.2 Force majeure includes, but is not limited to, governmental measures, import or export restrictions, logistical disruptions, pandemics, shortages of raw materials and other circumstances beyond Rexar’s reasonable control.
9.1 Information provided on the website, in product descriptions and in any datasheets is supplied solely to support analytical and laboratory-related activities.
9.2 Such information shall not be construed as medical, therapeutic or nutritional advice.
10.1 Rexar operates within the framework of applicable European legislation, including the REACH Regulation.
10.2 The customer is solely responsible for compliance with national and local laws regarding the acquisition, possession, storage, transport and use of chemical substances.
11.1 All agreements with Rexar shall be governed exclusively by Dutch law.
11.2 Any disputes shall be submitted to the competent court in the district where Rexar is established, insofar as legally permitted.
12.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.2 Rexar reserves the right to amend these Terms and Conditions at any time. The most recent version will always be available on the website.
